Terms of Use

The Site is offered to people who:

• Are 18 years old or older;
• Can legally form a binding contract;
• Live in the United States or one of its territories or possessions; and
• Own the property being asked about, or are authorized to act for the person who does.

By using the Site you confirm that all of this is true. If it is not, please stop using the Site.

TextmyRefi is an exploration tool. It helps you work out roughly how much of your built-up equity might be available and then puts you in touch with a licensed home-equity professional who can tell you what is actually on offer.

TextmyRefi is not a lender and does not make loans. Nothing on the Site is a commitment to lend, an approval, a pre-approval, a rate quote, or an offer of credit. Any figure you see is an estimate, not a promise.

The home equity calculator multiplies the property value and mortgage balance you type in by a combined loan-to-value limit that you can adjust, which defaults to 80%. Change those numbers and the estimate changes. The result ignores fees, taxes, liens, second mortgages, occupancy rules, property condition, credit, and the many other things a real lender considers.

The amount you could actually receive, the interest rate, and the terms of any loan are decided by a licensed lender after a full application and underwriting, and may be different from anything shown here. A HELOC is secured by your home, so you could lose it if you do not keep to the terms of the loan.

We do not run a credit check on this Site, and we never ask for a Social Security number, bank account details, online banking credentials, or copies of your documents.

You are responsible for the information you give us, and it must be correct, current, and complete. If it is not, we may not be able to help you, and you may be responsible for any consequences.

Only submit information about another person if you are allowed to, and only about your own property. Do not submit information belonging to someone you are not connected to.

The way we collect, use, and share information is described in our Privacy Policy, which forms part of these terms. By using the Site you agree to those practices. You can reach the Privacy Policy from the link in the footer of every page.

If you opt in, we and the participating providers we connect you with may send you text messages or place calls — including automated or prerecorded calls — at the number you give us. Messages may include:

• Confirmation that we received your home-equity request;
• Follow-ups from a home-equity professional about potential options;
• Messages to arrange or confirm a time to talk;
• Notifications that your requested options are ready, with a link to review them; and
• Answers to questions you raise with customer support.

Message frequency varies. How many messages you get depends on what you ask and whether you reply. Standard message and data rates from your wireless carrier apply — ask your carrier if you are unsure.

Reply STOP at any time to cancel. We will send you a confirmation that you have been unsubscribed, and after that you will not receive further program messages unless you opt in again — through the same sign-up process, or by replying START where that is supported. Reply HELP if you need assistance.

Giving consent is voluntary. It is never a condition of buying anything or of getting information about home-equity options, and you can ask us to remove your number from the program at any time.

Wireless carriers are not responsible for messages that are delayed or never delivered. Delivery depends on your carrier and network, which are outside our control, and text features may not be available on every device or in every area.

Your text opt-in data and consent are not sold or shared with third parties for their own marketing. They are only passed to the messaging providers needed to run the program.

You may use the Site only for lawful purposes. You agree not to:

• Break any federal, state, local, or international law or regulation;
• Use the Site in a way that could harm, exploit, or attempt to exploit anyone under 18;
• Submit information about another person without permission, or information that is false or stolen;
• Send, upload, or spread material that is abusive, harassing, defamatory, hateful, sexually explicit, or that promotes violence or discrimination;
• Use the Site to send spam, junk mail, chain letters, or unsolicited advertising;
• Pretend to be TextmyRefi, a TextmyRefi employee, another person, or another company;
• Interfere with other people's use of the Site, or restrict their ability to use it;
• overload, disable, damage, or impair the Site, or run denial-of-service attacks against it;
• Use robots, spiders, scrapers, or other automatic tools to access the Site, its calculator, or its questionnaire;
• Introduce viruses, worms, Trojan horses, logic bombs, or other harmful code;
• Try to reach areas of the Site you are not permitted to use; or
• Copy, resell, or commercially exploit the Site, the calculator, or the service behind it.

You keep the rights to the answers, replies, and other content you send us. You give us and our partners permission to use, reproduce, and display that content for the purposes of answering you, providing the service, and operating and improving it.

We can monitor, refuse, or remove anything you send us, and we may disclose it where we reasonably believe we are required to by law, or where it is needed to investigate or prevent fraud, security incidents, or unlawful activity.

The Site and everything on it — text, layout, design, graphics, the calculator, and the "TextmyRefi" and "GoMaggie" names, logos, and product marks — belong to Ready Lend LLC, GoMaggie, or their providers, and are protected by copyright, trademark, and other laws.

You may use the Site for your own personal, non-commercial purposes: your browser may cache pages, and you may print or download one copy of a reasonable number of pages for your own use. Outside of that, you must not reproduce, redistribute, modify, publish, or create derivative works from anything on the Site, must not use our illustrations or graphics separately from their text, and must not remove or change any copyright or trademark notices.

You must not use our names or marks, or anything confusingly similar to them, without our prior written permission. Names and marks belonging to other companies are the property of their owners.

The Site may link to websites and resources we do not control. Those links are for your convenience only and are not an endorsement. We are not responsible for what is on them or for any loss or damage that comes from using them, and you use them at your own risk. You are welcome to link to our home page, provided you do it in a way that is fair and legal and does not suggest that we endorse you or your business.

We may revise these terms at any time. When we do, we will post the updated version here and change the "Last updated" date. Changes take effect as soon as they are posted, and your continued use of the Site means you accept them. Changes to the dispute-resolution provisions in section 15 will not apply to a dispute you already had with us before the change was posted. Please check this page from time to time, because these terms are binding on you.

We may withdraw or change the Site, or limit, suspend, or end your access to all or part of it, at any time and without notice — including if you break these terms. You can stop using the Site whenever you like, and you can end our text messages by replying STOP or asking us to remove your number. Sections that by their nature should survive — such as the disclaimers and the limitation of liability — continue to apply after your access ends.

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICE OR ITEM OBTAINED THROUGH IT IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SUCH SERVICES OR ITEMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL READY LEND LLC, TEXTMYREFI, GOMAGGIE, THEIR AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY LINKED WEBSITE, OR ANY CONTENT OR SERVICES OBTAINED THROUGH THE SITE — INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR DAMAGE TO YOUR DEVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS SECTION APPLIES TO THE FULLEST EXTENT PERMITTED BY THE LAW OF YOUR STATE AND DOES NOT LIMIT ANY RIGHT THAT CANNOT LAWFULLY BE LIMITED.

You agree to defend, indemnify, and hold harmless Ready Lend LLC, TextMyRefi, GoMaggie, and their affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these terms, your use of the Site, your submissions, or your violation of any law or another person's rights.

All matters relating to the Site and these terms, and any dispute or claim arising out of them, are governed by and interpreted under the internal laws of the State of Ohio, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of these terms or the Site must be brought exclusively in the federal courts of the United States or the courts of the State of Ohio, in each case located in the City of Delaware and County of Delaware.

These terms do not require you to resolve disputes by arbitration. Unless you separately agree with us to arbitrate, a dispute between us may be decided by a court.

Before you bring a claim, please contact us using the details below and give us a chance to resolve it. Nothing in these terms limits any right you cannot lawfully give up, and where your state's law gives you non-waivable rights, those rights still apply.

Any claim you may have arising out of or relating to these terms or the Site must be started within one (1) year after the claim arises; after that, it is permanently barred, to the fullest extent allowed by law.

If we do not enforce a provision of these terms, that is not a waiver of our right to enforce it later, and it is not a waiver of any other provision. If a court or tribunal of competent jurisdiction finds any part of these terms invalid, illegal, or unenforceable, that part will be removed or limited to the minimum extent necessary so that the rest of these terms remains in full force and effect.

These terms and our Privacy Policy are the entire agreement between you and Ready Lend LLC doing business as TextMyRefi about the Site, and they replace any earlier understanding, agreement, or representation — written or spoken — about the Site. If any part of this agreement is unenforceable, the rest continues to apply.
